Garden Suite Construction in Vaughan
Municipal water and sanitary sewer are required before a Vaughan lot can take a garden suite, so estate lots on wells or septic don’t qualify. On serviced lots, By-law 001-2021 allows one detached unit 4.0 m from the house, with a 1.2 m walkway and its own parking space. It can’t exceed the main dwelling’s floor area.

Worth knowing first
Estate lots on septic can’t add a garden suite
Vaughan permits an additional residential unit only on a lot with municipal water and sanitary sewer. Estate properties on private wells or septic systems, including some around Kleinburg and in the rural north, don’t qualify under By-law 001-2021 as amended in 2025. The alternatives are an addition to the main house for family use, or a site-specific rezoning or variance, which is uncertain and slow. If municipal services run along your road, connecting to them first may open the option. So servicing is the first thing we check on a Kleinburg lot, before trees, TRCA mapping or the 4.0 m separation.

Frequently asked questions
Garden Suites in Vaughan: three local questions
Yes, on a qualifying lot. Vaughan allows 2 additional units: two inside the house, or one inside and one in a residential accessory structure such as a garden suite. That makes 3 units in total. Each needs its own parking space, a separate entrance and the 1.2 m walkway or driveway access, and neither can exceed the main dwelling’s floor area. We plan both units together.
At least 4.0 m from the principal building, under the 2025 amendments to Zoning By-law 001-2021. The structure also meets the zone’s rear and side setbacks, height and coverage. The Building Code can add limits close to a lot line or the house, such as window area or fire-rated walls. On a Maple or Woodbridge lot, the separation leaves room for a 55–75 m² (600–800 sq ft) suite.
An unobstructed, hard-surfaced walkway at least 1.2 m wide from the street to the suite’s entrance, or access from a driveway. Gates are acceptable if they don’t block it. Fences, air conditioners and stairs inside the 1.2 m width are not. On Maple and Woodbridge lots with narrow side yards, the walkway runs along the driveway. We measure the route at the first visit, because it can decide whether the suite is possible.
